Terms of Service

These terms apply when you use the KookaBrain app or this website. By using them, you agree to these terms. If you do not agree, do not use them.
1. Your account
You need an account to use the app. You are responsible for keeping your login details secure and for what happens under your account. Tell us at support@kookabrain.app if you think someone else has access to it. You must be at least 13 years old.
2. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use KookaBrain on devices you own or control, for your own learning. We keep all rights in the app itself, including its software, design, and name.
3. Your content
What you write and save stays yours. You grant us the licence we need to store it, sync it between your devices, and process it in order to provide the service—including sending your chat messages to a language model provider so it can reply. We do not use your content to train our own models. You are responsible for having the right to submit whatever you put in.
4. Acceptable use
Do not:
- use the app for anything unlawful, or to harass or harm anyone;
- try to break, overload, probe, or reverse-engineer the service;
- access another person's account, or use automated means to scrape the service;
- resell or redistribute access to the app;
- submit someone else's personal or confidential information.
5. AI-generated content
The assistant's replies and the review cards drafted from them are generated by a language model. They can be wrong, incomplete, or misleading, and they are not professional advice—not medical, legal, financial, or otherwise. Check anything that matters against a reliable source before you rely on it. You decide what to act on.
6. Subscriptions and billing
Some features require a KookaBrain Premium subscription. Subscriptions are sold, billed, and managed entirely by Apple through the App Store. Price shown at checkout. A free trial is offered where Apple makes one available.
Because Apple handles billing, Apple's terms govern payment, renewal, and refunds. Your subscription renews automatically unless you cancel it at least 24 hours before the current period ends, and you cancel it in your Apple account settings rather than in the app. We cannot issue refunds; refund requests go to Apple.
7. Changes to the service
We may add, change, or remove features. If we discontinue the service altogether, we will give reasonable notice so you can export your data.
8. Ending your use
You can stop using KookaBrain at any time and ask us to delete your account as described in the Privacy Policy. We may suspend or end your access if you breach these terms, or if we are required to by law.
9. Disclaimer
The app is provided “as is”. To the extent the law allows, we do not warrant that it will be uninterrupted, error-free, or that the scheduling will produce any particular learning outcome. Nothing in these terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
10. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, or consequential loss, or for lost profits, revenue, or data. Where liability cannot be excluded, it is limited—at our option—to supplying the service again or paying the cost of having it supplied again.
11. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
12. Changes to these terms
If we change these terms we will update the effective date above, and we will tell you in the app if the change is material. Continuing to use KookaBrain after a change means you accept the updated terms.
